Ključni zakoni

  • Accelerated 24-hour asylum procedures at federal asylum centres

    Asylum and migration2024

As FDJP head, Jans rolled out accelerated asylum procedures, including a fast-track 24-hour procedure for applicants with low prospects of success, and extended these procedures to federal asylum centres with a procedural function. Switzerland also limited the days on which asylum applications can be lodged.

Značaj: Central plank of Jans' asylum policy aimed at speeding up rejections and returns; Switzerland recorded one of the highest return/deportation rates in Europe in 2024. Critics questioned whether the measures were substantively tougher or largely presentational.

  • Federal Act on Electronic Identity (e-ID Act)

    Digital identity / data protection2025

The state-issued e-ID Act, in Jans' FDJP portfolio (Federal Office of Justice), was narrowly approved in the popular vote of 28 September 2025 (about 50.4 percent in favour), creating the legal basis for a government-issued digital identity. After the vote, Jans instructed the Federal Office of Justice to incorporate opponents' main concerns, with a focus on strengthening data protection.

Značaj: Revives the e-ID project after voters rejected a privately issued version in 2021; establishes a state-run digital identity infrastructure.

  • Partial revision of the Ordinance on the Surveillance of Post and Telecommunications (VUEPF / VD-UEPF)

    Telecommunications surveillance / data retention2025

The Federal Council, on a proposal from Jans' FDJP, put forward a partial revision of the VUEPF surveillance ordinances that would extend identification and data-retention obligations to a broad range of electronic communication service providers and retain metadata for at least six months. The draft was issued via ordinance rather than primary legislation.

Značaj: A contested expansion of state surveillance capacities; privacy organisations and several Federal Council parties criticised it, and Parliament called for fundamental revision (see polemics).

  • Switzerland-EU package (Bilaterals III) - immigration safeguard clause

Free movement of persons / migration2025

The Federal Council approved the negotiated Switzerland-EU package and opened the consultation on 13 June 2025. Within the package, a safeguard clause allows Switzerland to temporarily restrict free movement of persons when defined thresholds (net immigration, unemployment, social assistance) are exceeded. Domestic implementation of immigration-related elements engages the FDJP and the State Secretariat for Migration under Jans, while the overall negotiation was led by the Department of Foreign Affairs.

Značaj: Politically sensitive immigration dimension of the most significant Switzerland-EU treaty package in years; the safeguard clause is designed as an exceptional, time-limited tool.
